These Terms and Conditions ("Terms") govern your use of the website webuyanydecking.co.uk ("we," "us," "our") and the services we provide. By accessing or using our website and services, you agree to these Terms in full. If you disagree with any part of these Terms, you must not use our website or services.

 

General Terms and Manager’s Discretion

The terms outlined in this document are general guidelines for the sale and purchase of decking. While we aim to adhere to these conditions, webuyanydecking.co.uk reserves the right to make exceptions based on individual circumstances.

For example:

  • Decking Age: Although decking under 3 years old is typically required, sales of decking older than 3 years may be considered at the sole discretion of the manager. This decision will depend on factors such as the condition of the decking, its location, and other relevant circumstances.

  • Other Exceptions: In situations not explicitly covered by these Terms, or in cases where strict adherence to these Terms may not be feasible, the manager's discretion will be final. This includes any adjustments to pricing, deadlines, or requirements related to the sale and removal of decking.

Any exceptions made under the manager’s discretion must be confirmed in writing to be valid.

 

1. Definitions

  • "Customer" refers to any individual or entity offering decking for sale to webuyanydecking.co.uk.

  • "Decking" refers to the decking materials, structures, or related components being offered for sale to us.

2. Eligibility for Decking Purchase

To be eligible for us to purchase your decking, the following criteria must be met:

  • Age of Decking: The decking must be under 3 years old at the time of the sale. We reserve the right to verify the age of the decking through any means we deem appropriate.

  • Location: The decking must be located in North Wales. We do not currently purchase decking located outside of this region.

  • Communication and Permissions: The Customer is responsible for ensuring that all necessary permissions and agreements are in place between themselves and any third-party site owner, such as a holiday park or landlord. This includes but is not limited to the removal of the decking and access to the site. All communication and permissions must be agreed upon between the Customer and the site or park management before our arrival.

Failure to comply with these terms may result in the forfeiture of any deposit or payments already made by the Customer, as outlined in Section 7 below.

3. Offer and Acceptance

  • We reserve the right to refuse or withdraw any offer to purchase decking at our sole discretion.

  • An offer to purchase will only be confirmed once all necessary inspections have been carried out and all terms have been agreed upon in writing by both parties.

4. Pricing and Payment

  • The price offered for the decking is based on its condition, age, and market factors at the time of assessment. Once an offer is accepted, payment will be made in the manner agreed upon between the parties.

  • Any alterations to the condition of the decking between the time of the offer and our collection may result in a revision or withdrawal of the offer.

5. Condition of Decking

The decking offered for sale must be in good condition, subject to the normal wear and tear expected for decking under 3 years old. If any undisclosed damage or defects are found during inspection, we reserve the right to revise our offer or decline the purchase.

6. Site Access and Removal

  • The Customer is responsible for ensuring that there is clear and safe access to the site where the decking is located. We are not responsible for arranging permissions or gaining access to restricted areas.

  • Any additional costs associated with gaining access to or removing the decking from the site will be borne by the Customer, unless agreed otherwise in writing.

7. Non-Refundable Deposit

  • Failure to comply with the communication and permissions requirement (as outlined in Section 2) will result in forfeiture of any deposit paid. The deposit is non-refundable if it is determined that the required permissions were not obtained prior to our arrival, or if access to the decking is denied by the site or park management.

  • In such cases, no further payments or compensation will be made by webuyanydecking.co.uk.

8. Cancellations and Refunds

  • If you wish to cancel the sale of your decking, you must notify us in writing at least 48 hours before the scheduled collection. In the event of cancellation, any deposit paid may be forfeited depending on the circumstances and our discretion.

  • Refunds for deposits or payments will only be considered under exceptional circumstances and must be agreed upon in writing.

9. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising out of or in connection with the sale or purchase of decking, including but not limited to lost profits, damage to property, or any breach of contract between the Customer and third-party site owners.

Our liability in relation to the purchase of decking will not exceed the total price paid for the decking.

10. Warranties and Representations

The Customer warrants that:

  • They are the legal owner of the decking being sold, or they have full authority to sell it.

  • The decking is free from any encumbrances, liens, or third-party claims.

  • All information provided to webuyanydecking.co.uk regarding the decking is accurate and truthful.

11. Data Protection

We will process any personal data provided by the Customer in accordance with our [Privacy Policy]. We will only use your personal information for the purposes of fulfilling the sale and related communications unless you have opted into receiving marketing communications.

12. Amendments

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be posted on this page, and it is the Customer’s responsibility to review these Terms periodically. By continuing to use our website and services after changes are made, you agree to be bound by the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
